Dallas woman fuming over smoking neighbor at complex

I am pretty sure this lady is a jerk.  smoking neighbor

I am not a smoker and I have some sympathy for the desire to get rid of smoking in restaurants.  I think trying to get rid of it in bars is a little silly – even if I do enjoy smoke free bars.

But saying you are so sensitive to smoke that it is a crime for your neighbor to do it – well you just slipped over into crazy land.  Especially a jerky move considering she re-signed the lease while this was going on.

If you are so sensitive to smoke that you have to wear a respirator because YOUR NEIGHBOR is smoking – you should not be in a townhome.  You need to be somewhere where you are under more constant supervision by medical personnel.

For what it is worth, it appears that she isn’t going to win.

Wider recycling rules for Austin apartments, businesses considered

This article has received a lot of attention already.

I wanted to focus on this part of the article

“We want to make sure everyone in Austin has the opportunity to recycle, regardless of where they work or live,” Cofer said.

Let me remind everyone that everyone in Austin does have the opportunity to recycle.  They can move into one of the places that already recycles.  They can work somewhere that already recycles.  They want someone else to do it for them.  And more importantly the want someone else to pay for it.

I’d be curious to hear what others think.

eFiling causing an increase of eviction cases

I think this is a good idea.

The advantages to the property owners are obvious, but I think there is a not so obvious advantage to most renters.  If it is easier to evict people…owners are more likely to work with people.  They may accept people with lower credit or may cut you some slack if you get behind if they know it is easy to get rid of you

Federal Housing Rescue Plan Could Increase Rental Shadow Market

According to this article, government officials are considering a plan to pay the mortgages on houses that would otherwise be foreclosed on and then rent those houses back to the former owners at a price they would be able to afford.

This idea comes as a response to the slow progress that the initial housing rescue plan has made.  Red tape and rising interest rates have slowed the progress to refinance mortgages and lower payments for homeowners.

In 2008, the shadow market absorbed a lot of renters, as homeowners attempted to recoup some of their losses by renting out their homes.  More and more of those rental units are being foreclosed on and driving renters back into the apartment market.

If the housing rescue plan goes through, Mr. Willet’s predictions that “[rent] revenues will come down a little bit more, maybe somewhere around 2 percent…and real recovery will take place between 2011 and 2013,” would certainly seem accurate.

Be careful when using Craigslist to look for a place

This is a little different spin on the average Craigslist scam.  Instead of trying to get you to send them money, they lure you in with really cheap rent and try and get you to give up a lot of personal information.

You can read the whole story here, but I gave you the gist of it.  The most interesting part of the story is the last sentence

Believe it or not, APD said it’s not a crime to claim you own someone else’s house and try to rent it out. However, it is identity theft if someone uses your personal information to steal from you.

Go figure.

New Foreclosure Rights in Federal Law

The President signed into a law a bill (Protecting Tenants in Foreclosure Act)that provides protection for tenants living in foreclosed buildings .

These provisions immediately went into effect and are “self-executing,” so no federal agency is responsible for making them work.  It is up to advocates to make sure that tenants, landlords, public housing authorities, courts, the legal community, and others involved in the foreclosure process are aware of these new rights for tenants.

Austin veteran not allowed to hang flag at apartment

You may have already heard about this one. A veteran living at Village At Gracy Farms was told that he isn’t allowed to hang a US flag from his balcony.  He pulled it off the balcony and hung it on his wall.  He was told that he had to move it again since it could be seen through his window.

I’m a veteran but I am actually a little torn about this one.  It definitely seems ridiculous that he can’t fly his flag, but you can imagine it would definitely be an issue if everyone hung things on their balcony.  Fair Housing laws would probably make it very difficult to limit what could be displayed if you allowed anything to be displayed.

Although, I don’t know what could be the excuse for not letting him display it indoors.  I’m sure plenty of decorations can be seen on walls of many apartments and I am very skeptical his lease prohibits things from being seen through a window.

Needless to say…this is attracting a lot of attention.  I’m pretty curious to see where it goes.

Affordable Housing may be going Green

Bill H.R. 2336 or the Green Resources for Energy Efficient Neighborhoods Act of 2009 (GREEN Act), which was recently reintroduced in the House by Representative Ed Perlmutter (D-Colo.), authorizes new federal resources for green affordable development while providing incentives to the private sector to invest in green affordable homes for low-income people.

The GREEN Act would require the U.S. Department of Housing and Urban Development (HUD) to go green and adopt minimum building efficiency standards with rewards for higher performance. To jumpstart these efforts, HUD recently issued a Notice of Funding Availability (NOFA) to public housing authorities (PHA) applying for the Capital Fund Recovery Competition Grants under the stimulus.

The NOFA requires that if a PHA wants to compete for $300 million to be used for new construction or substantial rehab, they must use select elements of Enterprise Green Communities Criteria.
